Presently, objections raised in support of President Asif Ali Zardari on the Societies Registration (Amendment) Bill 2024 have given rise to an exaggerated amount of debate across the political and societal levels. The proposed bill aims at getting the madrasas registered under the Societies Act. This has come under scrutiny because of its potential to trigger global sanctions, including penalties by FATF and GSP+.
Raised by the support of the President in The Madrasa Act Debate
President Zardari brought forth eight essential objections towards the suggested legislation, including its significance for Pakistan’s international prestige and domestic unity. Major concerns among those include,
1. Conflict of Interest: The president argues that the registration process is likely to open avenues where madrasas may misuse their services other than being educational institutions. It can draw attention and criticism abroad.
2. International Sanctions: the alignment of the bill to the compliance framework of the FATF had once attracted question marks and apprehension that it would adversely affect rankings and international relationships of Pakistan.
3. Sectarianism and Law & Order : The threat of sectarianism was raised on the backdrop of the working of over one seminary in a particular locality, which threatened the social setup.
4. Conflicting Definitions: The bill introduces a definition of madrasas that is in variance with the existing laws; the Madrasa Education Board Ordinance 2001 and the Islamabad Capital Territory Trust Act 2020. This is a felony inconsistency that, at one point, had been identified as problematic.
5. Restricted Coverage: The Societies Registration Act 1860 traditionally only applies to Islamabad. The lack of such a clause in the newly introduced amendments raises questions on its jurisdictional scope.
6. Cultural Contradictions: Inclusion of madrasa training in an act that was previously termed contradictory to its preamble because it included acts that traditionally help exceptional arts training, such as dance and artwork classes.
Recommendations and Warnings
President Zardari cautioned the lawmakers to think of the greater implications on the global level of passing the bill. He also cautioned that defective rules could weaken the criminal grip on madrasas and would open up avenues for global criticism. He emphasized the need to draft laws that conform to the international regulatory frameworks, of which Pakistan is a part of.
Political Reactions and Counterarguments
The Jamiat Ulema-e-Islam-Fazl (JUI-F) sharply criticized the president’s objections, stating that he had surrendered to external pressure. JUI-F spokesperson Aslam Ghori contended that objections have been presented beyond the constitutional timeline. He also noted some procedural lapses such as failure to follow proper channels while airing objections.
Wider Implications. The Societies Registration (Amendment) Bill 2024 is at the intersection of home governance and global diplomacy.
