    Supreme Court Rejects 50% Vote Petition, Imposes Fine

    ISLAMABAD: The Supreme Court (SC) has rejected the petition that aimed to declare candidates who receive more than 50% of the votes as successful in elections and has imposed a fine of Rs 20,000.

    Justice Aminuddin Khan led the Constitutional Bench of the Supreme Court in reviewing the petition to declare the candidate with over 50% of the vote as the winner.

    During the hearing, Justice Muhammad Ali Mazhar inquired about the constitutional provision that mandates 50% of votes for a candidate in an election. The votes cast during the election determine the winner. Before determining which petitioner’s fundamental rights have been violated, Justice Ayesha Malik advised identifying the constitutional clauses.

    Justice Jamal Kahn Mandokhail stated that the Supreme Court does not possess the authority to create a new law. In the hearing, Justice Mandokhail inquired if the petitioner had voted in the February 2024 election.The petitioner stated that he did not vote in the election, to which Justice Mandokhail responded that this disrespects the constitution. Additionally, the Supreme Court informed the Full Court of the 59,191 cases currently pending before it.
    The Full Court has reported that there are currently 59,191 cases pending before the Supreme Court.

    All judges of the apex court attended the two-hour meeting, which Chief Justice of Pakistan Yahya Afridi led. Justice Mansoor Ali Shah, who is currently in Saudi Arabia for Umrah, joined the proceedings through a video link.
