    Supreme Court Cracks Down on Illegal Second Marriage

    The Supreme Court filed civil action against a person who will seek for Illegal Second Marriage without the first wife permission

    The Supreme Court of Pakistan just made a huge statement, backing up women’s rights in marriage and making it clear that sneaky second marriages won’t fly. If a guy gets hitched a second time without his first wife’s okay or the Arbitration Council’s go-ahead, he’s gonna face some serious trouble, both in court and maybe even with the police.

    This all started with Naila Javed case. Her husband remarried without following the rules, and now the court’s saying that’s not cool. People are saying this is a major victory for women who deserve to be treated fairly in their marriages.

    How It All Played Out

    So, Naila Javed called out her husband for his second marriage, saying he didn’t get her permission or the Arbitration Council’s okay, which he’s supposed to do. Even though he broke the rules, the lower courts didn’t really do much about it at first.

    That’s when the Supreme Court stepped in. They said the family law was being twisted and made sure Naila got her rights back.

    Justice Musarrat Hilali Says No Way!

    Justice Musarrat Hilali really laid down the law in her decision. She overturned the earlier rulings and told the husband he had to pay Naila Javed Rs1.2 million that he owed her. She said he was basically bullying her by not supporting her and trying to get around the rules.

    The court’s message was clear: if you don’t follow the law about second marriages, you’re gonna get hit with criminal charges and have to pay up. No more wiggling out of it.

    You Can’t Just Force a Divorce

    Here’s another big thing: the Supreme Court said you can’t just turn a divorce into a khula without the woman agreeing to it.

    Justice Hilali made it obvious that khula is a woman’s right, and guys can’t use it as a trick to avoid paying up for things like support payments. If they try, it’s illegal and just plain wrong.

    Second Marriage Needs Consent

    Just to be crystal clear, here are the rules for second marriages in Pakistan:

    • The first wife has to say it’s okay in writing.
    • The Arbitration Council has to give the thumbs up.

    If you don’t do these things, the second marriage isn’t legal, and the guy could be looking at fines, jail time, and having to pay the wife what she’s owed.

    This should stop guys from thinking they can just do whatever they want and hide behind religion.
